Real Estate Records, 1825 - 1949

             This book contains abstracts of all of the loose real estate papers for Newberry County. Real Estate court was established in December 1824 to give jurisdiction to the Judges of the Courts of Ordinary throughout the State to order the sale or division of real estates not exceeding $1,000. These estates could be handled by an application of a person interested to make a division of the real estate of a person who may have died intestate or leaving a will provided it did not direct otherwise. Previous to this such matters were handled in the court of equity. These records contain much genealogy and are the most under-used resource available. This book is 8-˝ x 11 spiral bound, 136 pages, full index, by Edith Greisser.

District No. 2 – Military Rule in S.C.

In going through a box of old papers of Newberry County records kept at the South Carolina Archives in Columbia, Edith came across mention of Military Order No. 25 which dealt with the production and selling of alcohol for consumption, in effect creating a prohibition for the times. In the Nation there were only two libraries which contained a full set of the Military Orders for Military District Number Two, contained in the Executive Document No. 342 of the House of Representatives, 40th Congress, 2nd Session. Following are those Military Orders. Edith said she has only slightly edited for easier reading, otherwise, the words and wording remain as originally issued. This work follows the Equity Records 1845-1865. Equity Courts as a separate forum ceased at the end of 1869 and were incorporated into the Circuit Courts starting in 1870. The LDS films from which these Equity Records were abstracted continued with the beginning of the records of the Washington District (Laurens, Newberry and Greenville Districts), starting with 1816 (only 1 record on the film). Introduction: A lot of time and energy was spent organizing and writing this book. First, I abstracted Will Book L. Then I spent a week in Newberry County, S.C. going through the annual returns of each estate. Then the equity records for Newberry County, S.C., for the years 1826-1844 were abstracted. I then went through the equities looking for pertinent information on each family. Then the book Annals of Newberry by O'Neall and Chapman was checked.
